Sri Lanka Marxist party to move a motion against Attorney General

May 13, Colombo: Sri Lanka's Marxist party Janatha Vimukthi Peramuna (JVP) has decided to move a motion against the special appeal filed by Attorney General (AG) Palitha Fernando on April 30 against a judgment of the Court of Appeal regarding the impeachment of former Chief Justice Dr. Shirani Bandaranayake.
Sri Lanka's Supreme Court acting on the AG's appeal issued a notice on former Dr. Bandaranayake and TNA MP R. Sampanthan and JVP MP Vijitha Herath, who were opposition members of the parliamentary select committee that probed the former Chief Justice, to appear before the court on 29 May.
The AG in his appeal submitted to the court said the judgment by the Court of Appeal in favor of former Chief Justice and the writ of certiorari issued preventing the implementation of the Parliamentary Select Committee report set a bad precedent.
The AG said that according to Parliamentary Privilege Act no court can issue a writ or an order to Parliament on its activities and under the Constitution the removal of Supreme Court and high court Judges on disciplinary action is entrusted to Parliament.
JVP Provincial Councilor attorney-at-law Sunil Watagala has told local Hiru FM radio that the decision to move the motion against AG's appeal would be taken today. He has said that MP Herath however, has not been notified yet by the court.
