The Supreme Court will, today, deliver the judgment on the preliminary objections by Parliamentarians R. Sambandan and Vijitha Herath to the granting of special leave to appeal to the Attorney General, who appealed against a judgment of the Court of Appeal, which quashed the findings of the Parliamentary Select Committee against the former Chief Justice, Dr. Shirani Bandaranayake.
The petitioners have complained that they were not notified by the appellant Attorney General, that the appeal had been filed. The petitioners were not given an opportunity to object to the granting of the leave to appeal. The Attorney General had appeared as amicus curiae in the Court of Appeal and hence he did not have the right of appeal.
The preliminary objections were argued before a five-Judge Bench of the Supreme Court, comprising Justices Saleem Marsoof, P. A. Ratnayake, Sathya Hettige, Eva Wanasundera and Rohini Marasinghe.
